Terms and Conditions

§ 1. SUBJECT OF THE TERMS AND CONDITIONS

1. The Terms and Conditions of the Facility apply within the Facility and concern all persons staying there.

2. The apartment owner is hereinafter referred to as the “Facility,” while the apartment tenant is referred to as the “Guest.” 


3. The Facility Regulations define the rules for the services provided, consisting of short-term apartment rental, the responsibilities of the parties to the agreement, and staying on the premises of the Facility, and are an integral part of the agreement, which is concluded by making a reservation, paying a deposit or the entire amount due for the stay, or by completing an electronic registration card. By performing the above actions, the Guest confirms that they have read and fully accept the terms and conditions and undertake to comply with them.

§ 2. STAY

1. Apartments in the Facility are rented on a daily basis. 


2. The day begins at 3:00 p.m. and ends at 11:00 a.m. the following day. 


3. Extending the day is subject to an additional fee. The fee for extending the day is PLN 100 per hour. Detailed information on fees related to extending the day can be obtained by phone. The Facility reserves the right not to extend the day.

§ 3. RESERVATION AND REGISTRATION

1. Reservations can be made online or by phone.

2. If the Guest cancels the reservation, which is tantamount to withdrawing from the contract, within 5 days before the start of the stay, the Facility shall refund 100% of the reservation value. After this deadline, the Facility shall not refund the amount paid and, in the event of failure to make the full payment, shall have the right to claim the full amount of the reservation from the Guest.

3. Additional charges resulting from the stay shall be paid by the Guest on the day of departure at the latest.

4. If the Guest leaves the Facility earlier than specified in the reservation agreement, the difference in the cost of the stay shall not be refunded.

5. If the Guest does not arrive at the Facility on the agreed date, this shall be tantamount to the Facility's withdrawal from the contract with the right to retain the payment, and the apartment may be rented out.

6. The basis for accepting a Guest is the payment for the reservation and the completion of an electronic registration card.

7. The Guest may not transfer the apartment to third parties, even if the period for which the Guest has paid the fee for the stay has not expired.

8. Persons not registered at the Facility may stay in the apartment from 7:00 a.m. to 10:00 p.m. at the Guest's invitation.

9. The facility may refuse to accept a Guest who, during a previous stay, grossly violated the regulations, causing damage to the property of the facility or otherwise disturbed the peaceful stay of Guests or the functioning of the Facility.

10. The Facility reserves the right to refuse to accept a Guest without giving a reason.

§ 4. LIABILITY OF THE FACILITY

1. The Facility is not liable for the loss or damage of items left by the Guest at the Facility.

2. Guests should notify the Facility of any damage immediately after it is discovered.

3. The Facility is not liable for theft of money, theft, damage, or destruction of securities, valuables, or items of value.

4. The Facility shall not be liable for items left on the balcony, in a vehicle, or live animals, regardless of whether the vehicle was parked in the Facility's parking lot or outside the Facility's premises.

§ 5. GUEST RESPONSIBILITY

1. Children under the age of 12 should be under the constant supervision of their legal guardians while on the premises. Legal guardians are financially responsible for any damage caused by children.

2. Guests shall bear full financial responsibility for any damage or destruction of the Facility's equipment and technical devices, as well as the building in which the Facility is located, caused by their fault or the fault of their visitors.

3. The Facility reserves the right to charge the Guest's payment card for any damage found after their departure, and in the absence of card details, it has the right to request financial compensation from the Guest.

4. In the event of any faults or damage in the apartment, the Guest is obliged to inform a Facility employee by phone or email.

5. In the event of a breach of the regulations, the Facility may unilaterally terminate the contract with immediate effect with the Guest who breaches them, while retaining the right to full remuneration. The Guest is obliged to immediately comply with the Facility's requests, settle the payment for the stay and any damage, and leave the Facility.

6. For safety reasons, the Guest leaving the apartment should turn off the taps and close the door.

7. The Facility has a statutory right of lien on items brought by the Guest to the Facility in the event of a delay or failure to pay for the services provided.

§ 6. RETURN OF LEFT-BEHIND ITEMS

1. Personal items left behind in the apartment by a departing Guest will be available for collection at the address indicated.

2. If no instructions are received from the Guest regarding the items left behind within 24 hours of leaving the Facility, the Facility will consider them abandoned.

§ 7. NIGHT-TIME QUIET HOURS

1. Night-time quiet hours are in effect at the Facility from 10:00 p.m. to 7:00 a.m. the following day.

2. The behavior of Guests and persons using the services of the Facility should not disturb the peaceful stay of other Guests. The Facility has the right to apply the measures referred to in § 5(5) in the event of violations of the quiet hours.

§ 8. ADDITIONAL PROVISIONS

1. For fire safety reasons, it is forbidden to use open flames, e.g. candles, irons, electric irons, or other similar devices that are not part of the apartment's equipment.

2. The facility has the right to charge a deposit of between PLN 500 and PLN 1,000, depending on the type of apartment. The deposit will be refunded within two days after the end of the stay if no damage caused by the Guest or violation of the regulations is found.

3. We accept pets at the Facility for an additional fee and only with the consent of the Facility. The pet owner is required to notify us of their intention to book a stay with a pet.

4. Smoking is strictly prohibited in the Facility. In the event of a violation of this prohibition, the Guest will be charged a contractual penalty of PLN 500. If the Facility suffers damage exceeding the amount of the contractual penalty, the Facility may seek compensation on general terms.

5. In the event of a gross violation of the nighttime quiet hours, the Facility has the right to charge the Guest a contractual penalty of PLN 500.

6. The possession and use of illegal intoxicants is strictly prohibited in the Facility. If a violation of this prohibition is found, the fact will be reported to the police and the Guest will have to leave the Facility immediately without the right to a refund of costs resulting from the shortened stay at the Facility.

7. Dangerous items, i.e. weapons, ammunition, flammable materials, fireworks, etc., may not be stored in the apartments.

8. It is forbidden to make excessive noise on the premises, cause unpleasant odors, or perform other activities that disturb, harm, or irritate other guests of the Facility.

9. Guests are not allowed to make any changes to the apartments or their furnishings, except for minor rearrangements of furniture and equipment, without compromising their functionality and the safety of guests.

10. The administrator of personal data is Apartamenty Poznań sp z o.o., with its registered office in Skórzewo at ul. Wiosenna 7.

13. The court competent to settle disputes between the Guest and the Facility is the court competent for the registered office of Apartamenty Poznań sp z o.o.
